⚖️ Terms of Service

📝 1. Agreement to Terms

By accessing or using the KnowYourFood mobile application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and KnowYourFood ("we", "our", or "us"). We may update these Terms from time to time, and your continued use of the Service after any changes constitutes acceptance of the updated Terms.

🧑‍⚖️ 2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements. If you are using the Service on behalf of a family through the Family plan, you are responsible for ensuring all family members comply with these Terms.

🔒 3. Account Registration

To access certain features of the Service, you must create an account through our authentication provider. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

📱 4. Description of Service

KnowYourFood is a health-focused grocery comparison tool designed for Australian consumers. The Service allows you to scan product barcodes or search for products sold at Coles, Woolworths, and Aldi to view nutritional information, health scores, and healthier alternative recommendations. The Service also includes an AI-powered nutritionist chat feature (Vicki), shopping lists, scan history, family sharing, and dietary preference management.

Product information is sourced from the Open Food Facts open database and may not always be complete, accurate, or up to date. The Service is intended for general informational purposes only and does not constitute medical, dietary, or nutritional advice.

💰 5. Subscription Plans and Pricing

5.1 Free Tier

The free tier provides limited access to the Service, including a limited number of daily product scans and basic product information. Free tier users do not have access to premium features such as the Vicki AI nutritionist, advanced dietary filtering, or detailed health reports.

5.2 Premium Plan

The Premium plan is available at $24.99 AUD per year or $3.99 AUD per month. It includes unlimited product scans, access to the Vicki AI nutritionist (up to 10 conversations per day), advanced dietary and allergen filtering, detailed health reports, and a personal shopping list.

5.3 Family Plan

The Family plan is available at $39.99 AUD per year or $5.99 AUD per month. It includes all Premium features plus support for up to five family members, shared shopping lists with real-time collaboration, unlimited Vicki AI conversations, and push notifications for family list updates.

5.4 Pricing Changes

We reserve the right to change our subscription pricing at any time. Any price changes will take effect at the start of your next billing cycle. We will provide reasonable notice of any pricing changes via email or in-app notification.

💳 6. Billing, Auto-Renewal, and Cancellation

6.1 Web Subscriptions

Subscriptions purchased through our website are processed by our payment provider. Your subscription will automatically renew at the end of each billing period (monthly or yearly) unless you cancel before the renewal date. You can manage or cancel your subscription through the subscription management portal accessible from your account settings.

6.2 In-App Purchases (Apple App Store / Google Play)

Subscriptions purchased through the Apple App Store or Google Play Store are subject to the respective platform's terms and billing policies. Auto-renewal and cancellation are managed through your Apple ID or Google Play account settings. Payment will be charged to your App Store or Play Store account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.

6.3 Refunds

For web subscriptions, refund requests may be made within 14 days of the initial purchase or renewal by contacting us at [email protected]. Refunds are provided at our discretion and in accordance with Australian Consumer Law. For in-app purchases made through the Apple App Store or Google Play Store, refund requests must be directed to Apple or Google respectively, in accordance with their refund policies.

🚫 7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorised access to the Service, other accounts, or our systems
  • Use automated scripts, bots, or scraping tools to access the Service or extract data
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Share your account credentials with others or allow multiple people to use a single account (except through the Family plan)
  • Submit false, misleading, or malicious product corrections or feedback
  • Use the Vicki AI chat feature to generate content that is harmful, abusive, or inappropriate
  • Resell, redistribute, or commercially exploit the Service or its content without our written permission

✍️ 8. User Content and Contributions

You may submit content to the Service, including product category corrections, feedback reports, shopping list items, and chat messages ("User Content"). You retain ownership of your User Content, but by submitting it, you grant us a non-exclusive, royalty-free, worldwide licence to use, store, and process your User Content for the purpose of operating and improving the Service.

Category corrections submitted by users may be reviewed and, if approved, applied to improve the accuracy of the Service for all users. You represent that any User Content you submit is accurate to the best of your knowledge and does not infringe on any third party's rights.

©️ 9. Intellectual Property

The Service, including its design, code, features, logos, and branding, is owned by KnowYourFood and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent. Product data sourced from Open Food Facts is used under the Open Database License (ODbL) and remains subject to its terms.

⚠️ 10. Health and Nutritional Disclaimer

Important: The Service provides general nutritional information and product comparisons for informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Health scores, alternative recommendations, and AI-generated nutritional advice (including from Vicki) should not be relied upon as medical or dietary guidance.

Always consult a qualified healthcare professional, dietitian, or allergist before making dietary changes, especially if you have food allergies, intolerances, medical conditions, or are managing the diet of children. Product information may be incomplete or inaccurate, and we do not guarantee the accuracy of nutritional data, ingredient lists, or allergen information.

🛡️ 11. Limitation of Liability

To the fullest extent permitted by law, KnowYourFood shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the service; (b) any conduct or content of any third party on the service; (c) any content obtained from the service; and (d) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
